2. SwebApps iPhone applications must be approved by Apple prior to public distribution. SwebApps does NOT guarantee Apple approval. If a client opts to withdraw an application prior to submission to Apple, they are entitled to a full refund of the development fee. If an application is rejected by Apple when it is first submitted, SwebApps will provide Apple’s feedback to the client and offer a 50% refund of the development fee if the client chooses to abandon their application and not re-submit. If a client chooses to re-submit a rejected app, SwebApps will not offer a refund if the application is rejected a second time. If an application is rejected twice, SwebApps will only re-submit the application at its discretion on a case-by-case basis. SwebApps reserves the right to decline any iPhone application and offer a 100% refund prior to submitting to Apple.

Limitations

In no event shall SwebApps or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on SwebApps's Internet site, even if SwebApps or a SwebApps authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Revisions and Errata

The materials appearing on SwebApps's web site could include technical, typographical, or photographic errors. SwebApps does not warrant that any of the materials on its web site are accurate, complete, or current. SwebApps may make changes to the materials contained on its web site at any time without notice. SwebApps does not, however, make any commitment to update the materials.
